These Terms and Conditions of Service constitute a legally binding agreement between USERS and ALOHANDO, governing access to and use of the website, including any subdomains and any other websites through which its services are made available. Use of the ALOHANDO SITE by a USER indicates full acceptance of these Terms and Conditions and the Privacy Policy.
Accessing the services implies that the USER declares being over 18 years of age and capable of understanding and accepting these provisions. USERS may access through the website, mobile applications, tablets and other smart devices.
GOSMAY CREATIVE BRANDS is the administrator of ALOHANDO and its owner and legal representative.
The ALOHANDO SITE is an online marketplace designed to provide information and allow REGISTERED USERS to offer physical spaces for temporary accommodation, with duly specified additional services, and to communicate and manage bookings directly with other REGISTERED USERS.
ALOHANDO does not own, create, sell, resell, supply, control, manage, offer, deliver or provide any listing or property. The ALOHANDO SITE is solely a medium for providing information and a payment method for the security of transactions between USERS. Registered USERS are solely and exclusively responsible for their offers and listings and for complying with all applicable laws and regulations.
Before booking a listing, the potential guest will be presented with all applicable fees including corresponding taxes. Upon accepting payment, the USER will pay a single total amount covering all applicable charges.
The USER must respect these Terms and Conditions and use digital services correctly and lawfully. The administrator may suspend the account of any USER who violates them for being in breach of these T&C, offensive, illegal, violating third-party rights or threatening the security of other users.
The administrator may suspend a USER's account when false or incomplete information has been provided, when listings do not meet quality or eligibility criteria, when repeated negative reviews have been received, or when confirmed bookings have been repeatedly cancelled without justified reason.
ALOHANDO has no obligation to monitor access or review USER content, but does have the right to do so in order to operate, protect and improve the SITE and ensure compliance with these T&C.
Given the extreme difficulty of verifying users on the Internet, ALOHANDO assumes no responsibility for confirming the identity of any user.
The SITE distinguishes two types of USERS: the GUEST, who uses the accommodation service; and the HOST, who offers the accommodation service.
HOSTS are solely responsible for complying with all local and national laws, regulations and rules applicable to their listings and services. They must ensure capacity to accommodate guests and obtain permits to provide additional services (food, alcohol, transport, etc.).
GUESTS are responsible for leaving the accommodation and its contents in the same condition as upon arrival. They are also responsible for damage caused by their own negligence, their guests and other occupants. They may not sublet the property or disregard conditions set by the HOST.
All payment processing services will be provided within the SITE itself. Payments made through any other means not provided by the SITE will be invalid and unrecognized.
The administrator may only moderate the website and will not intervene in dispute resolution. It does not guarantee the truthfulness, quality, safety or legality of any HOST offer, service or listing, nor the conduct of any USER or third party.
The reference to a "REGISTERED USER" only indicates that the user has completed the registration process on the SITE. It does not imply any endorsement, certification or guarantee by the SITE regarding any user. The USER must always exercise due diligence when deciding whether to use another USER's services.
Verified images are intended solely to provide a photographic representation of a listing at the time the photograph was taken, and do not constitute an endorsement by the SITE. ALOHANDO cannot guarantee continuous and uninterrupted availability and accessibility of the SITE.
If you choose to use the SITE as a HOST, your relationship with the ALOHANDO SITE will be limited to that of an independent third-party contractor. ALOHANDO does not direct or control your actions or behavior.
The SITE will only display listings for properties located in URUGUAY. Any dispute arising between ALOHANDO and/or USERS will be resolved exclusively in the ordinary Civil and Commercial Courts of the city of Montevideo, Oriental Republic of Uruguay.
When ALOHANDO is required to present a judicial information request as evidence, this will have a cost of FIFTY US DOLLARS (US$ 50.-), or its equivalent in Uruguayan pesos, according to the value established by the Banco Central del Uruguay, seller rate, at the date of the request.
ALOHANDO reserves the right to modify these Terms and Conditions at any time. Changes will be published indicating the date of the last update.
New Terms and Conditions will take effect 5 days after publication. Modifications will be notified to the USER's registered email address at least five (5) days before they take effect. In case of disagreement, the USER may delete their profile at no cost. Silence after this period will be deemed acceptance.
Registering an account on the SITE is the act that allows one to become a USER, gaining access to its benefits and certain functions such as publishing or booking a listing.
Registration is done with an email address and password, or through third-party social media accounts such as Facebook, X or Google. You can disable the connection between your alohando.com account and your social media account at any time from "Settings".
Information provided must be accurate, current and complete. The profile does not handle sensitive data and data will be public to ensure transparency. The SITE may require identification documents such as national ID, passport or other documents in case of doubt.
Each profile accepts only one user. The same person cannot have multiple profiles. Profiles detected as fake may be deleted without prior notice. Accounts are personal and non-transferable.
For reports of misappropriation, hacking or identity theft, the SITE provides the email ayuda@alohando.com. USERS are responsible for maintaining the confidentiality of their login credentials and must immediately notify the SITE of any unauthorized use of their account.
The ALOHANDO SITE may contain links to external third-party websites subject to different terms and conditions for which ALOHANDO is not responsible. Links to such services do not constitute an endorsement by ALOHANDO.
ALOHANDO moderates the site with criteria of respect and good conduct, reserving the right to deactivate, suspend, hide, silence or restrict accounts of USERS who do not comply with community guidelines or who have provided false information.
USERS may create, upload and store content (audio, video, text, photographs) related to their activity on the SITE. USERS are solely responsible for all content they publish and for not infringing intellectual property or privacy rights.
It is expressly prohibited to publish fraudulent, false, defamatory, injurious, vulgar or offensive content; content that promotes discrimination, racism, hatred or harassment; violent or threatening content; or content that promotes illegal activities or substances. This is not an adult content site. ALOHANDO may remove or disable access for the offending USER without prior notice.
Anyone who offers a listing guarantees that they have taken all necessary precautions not to breach any contract with third parties that could harm the GUEST, that their offer is authorized by co-ownership regulations, that it does not affect the rights of co-owners, and that it complies with all municipal, provincial and national laws, as well as tax and fiscal requirements.
BUCHU S.A. is the sole owner of the "ALOHANDO" brand. It may not be used, copied, modified, adapted or distributed except through means expressly authorized on the SITE. ALOHANDO grants a limited, non-exclusive, non-sublicensable, revocable and non-transferable license to access and use the SITE.
ALOHANDO shall have the right to use any images posted by USERS for advertising and marketing purposes on any medium or platform, without notification or compensation. By posting content on the SITE, you grant ALOHANDO a non-exclusive, worldwide, royalty-free, irrevocable and perpetual license over such content.
Service fees are collected through alohando.com. Unless otherwise stated on the SITE, service fees are non-refundable.
The GUEST will have access to all listing-related information before booking. From the moment the GUEST accepts the offer by entering their credit card details, a binding expression of will is formed with payment and compliance obligations.
A confirmed booking constitutes a limited authorization granted by the HOST to the GUEST to access, occupy and use the physical space for the duration of their stay.
When creating a listing it is essential to provide complete, accurate and detailed information about the HOST service, specifying location, available dates and disclosing any property deficiencies.
The HOST is free to set the price for the stay. Once the GUEST accepts the offer, the HOST must honor that price. Under no circumstances may the HOST demand a higher price than the one advertised in the accepted listing.
Search uses algorithms based on user preferences, host requirements, features, quality, prices, availability and eventually paid premium services to obtain better positioning.
ALOHANDO considers that the GUEST approves an offer by entering their credit card details, which implies having read all Terms and Conditions and entering into a legally binding contract with the HOST.
Within 15 days of the end of a stay, participating USERS may leave public comments and ratings from 1 to 5 stars. The SITE does not endorse or adhere to such opinions, and only moderates comments to ensure they are accurate, non-offensive and refer solely to service quality.
ALOHANDO is not responsible for any damage the HOST's property may suffer during the GUEST's stay. Insurance policies specifically designed for property incidents are available to the HOST.
The GUEST must vacate the accommodation at the agreed time. If they extend their stay without the HOST's consent, the authorization to remain will be automatically revoked and they will lose their GUEST status, entitling the HOST to initiate corresponding legal actions.
Cancellation policies are set by the HOST and included in the listing. GUESTS may cancel a confirmed booking at any time subject to the penalties set out in the listing policy. Once check-in has occurred, a GUEST who chooses to leave early has no right to a refund for unused nights, except in extraordinary or force majeure circumstances.
If a HOST cancels a confirmed booking, the GUEST will receive a full refund. ALOHANDO may post an automatic comment on the cancelled listing and impose a cancellation fee, unless the HOST has justified cause.
ALOHANDO may decide to cancel a pending or confirmed booking when deemed necessary to avoid or prevent significant harm to the SITE, its members, third parties or material property.
If a HOST files a damage claim, they may explain the reasons and amount sought through the SITE. The claim will be notified to the GUEST, who will have 5 days to respond, accept, counter-offer or deny it. Silence will be considered a denial. If an agreement is reached, ALOHANDO will collect the agreed amount through the same method used for the stay.
Users agree to cooperate with the SITE and act in good faith. ALOHANDO will act as a mere facilitator between the parties, processing debits and transfers as decided by the parties.
The GUEST may express dissatisfaction and request financial compensation through the SITE's channels. The HOST will have 5 days to respond. The procedure is analogous to that described in point 16.1, with roles reversed.
The HOST is responsible for determining, declaring, collecting and remitting VAT and any other applicable taxes, which must be included in the final listing price. The HOST may not charge additional taxes or services outside the final price. ALOHANDO invoices only the commissions corresponding to the service provided.
USERS are solely responsible for complying with all laws, regulations and tax obligations applicable to their use of the ALOHANDO SITE.
No USER has the right to distribute messages unrelated to the purpose of the SITE (SPAM). USERS may not contact other USERS for purposes other than those related to bookings, listings or use of SITE services.
USERS shall not use the SITE to solicit, make or accept bookings outside of it, to avoid service fees, or to take actions that impair the performance or proper functioning of the ALOHANDO SITE.
These Terms and Conditions have a term of 30 days, automatically renewable for successive 30-day periods until the USER or ALOHANDO decide to terminate the commercial relationship.
Either party may terminate at any time by sending an email. If a HOST deactivates their account, all confirmed bookings will be automatically cancelled and GUESTS will be fully refunded. If deactivating as a GUEST, any refund will depend on the listing's cancellation policy.
The ALOHANDO SITE is optional and voluntary to access. Content is offered without warranty of any kind. USERS accept that relationships arising from the SITE carry the same risks as this type of commercial relationship and voluntarily assume such risks.
In cases where a USER stays with minors or persons with disabilities, they accept exclusive responsibility for supervising such persons throughout the stay, releasing ALOHANDO from any liability or claims that may arise.
USERS agree to indemnify, defend and hold harmless ALOHANDO and its representatives against any claim arising from breach of these T&C, misuse of the SITE or infringement of laws or third-party rights.
There is no partnership, cooperation, employment or agency relationship between USERS and ALOHANDO as a result of these T&C or use of the SITE.
If any clause is deemed null or unenforceable, such provision will be removed without affecting the validity of the remaining provisions.
For bookings made at least 20 days before check-in, host payments will be issued on the 5th business day after guest check-in. For bookings within 20 days of check-in, the payment date may be longer, potentially exceeding 10 business days after check-in. Delays due to causes beyond ALOHANDO's control (banking institutions, holidays, weekends) are not the company's responsibility.
Any notice and communication to USERS will take place electronically via email, SITE notification or SMS and/or WhatsApp messages. USERS commit to keeping their communication details up to date in their account profiles.
We welcome observations, comments and suggestions to improve the ALOHANDO SITE. These may be sent through the "CONTACT" section of the site or by email. Any observations will be considered non-confidential and without proprietary rights. By sending us observations, you grant ALOHANDO a non-exclusive, worldwide, royalty-free, irrevocable and perpetual license to use and publish those ideas for any purpose.
